September 8, 2011 - Within the European Union funded project "Access to Justice for Poor Women", MUSAWA, The Palestinian Center for the Independence of the Judiciary and the legal profession and Relief International "RI" aspired to enhance economic equality between women and men at the workplace and in the private sphere through improving the implementation and enforcement of national legislation in line with CEDAW, and through the Capacity-building of lawyers to advocate for women’s economic and social rights and access to justice. MUSAWA in cooperation with Relief International completed the implementation of more than 150 mobile legal clinics in the districts of Nablus and Jenin, Salfeet, Bethlehem and Hebron.

Musawa and Relief International successfully delivered 150 mobile legal clinics regarding the Palestinian Labor Law targeted approximately 1100 female worker in the West Bank


Within the European Union funded project "Access to Justice for Poor Women", MUSAWA, The Palestinian Center for the Independence of the Judiciary and the legal profession and Relief International "RI" aspired to enhance economic equality between women and men at the workplace and in the private sphere through improving the implementation and enforcement of national legislation in line with CEDAW, and through the Capacity-building of lawyers to advocate for women’s economic and social rights and access to justice. MUSAWA in cooperation with Relief International completed the implementation of more than 150 mobile legal clinics in the districts of Nablus and Jenin, Salfeet, Bethlehem and Hebron.

The mobile legal clinics predominantly aimed at providing adequate legal support to the beneficiaries in employment and economic cases, raise legal awareness for workers in general and working women in particular in marginalized areas within the targeted districts, in regards to the current Palestinian Labor law, and the rights and obligations that the labor law guarantees for employees, employers, local councils, trade unions and the role of government ministries to protect women socioeconomic rights.

Five Lawyers from earlier stage were contracted to conduct field visits to targeted districts and villages. These field visits aimed at assisting the local workers in cases where they feel their economic and employment rights have been violated. The contracted lawyers operated out of Musawa and Relief International’ network etc… (CBOs, local councils and Ministry of Labor offices) and received complaints and cases in those offices and provided technical and legal consultancies for the general public on relevant issues and adopted 20 public cases that violate the basic women and workers' rights.

The topic of these legal clinics revolved around rights and obligations of employees, employers, and the official sector according to the Palestinian Labor Law. Frequently it highlighted women’s rights in terms of the labor law articles and in compliance with international standards (salaries, end of service benefits, compensation, unfair dismissal, maternity and breastfeeding leave for working women etc…). In addition, it pinpointed various inquiries related to court procedures and how to appeal in issues of labor.

It is worth-mentioning the fundamental role of the Ministry of Labor (MoL) as a strategic partner in the implementation process of the project activities, whereas it contributed and facilitated the project team and lawyers’ access to small and medium sized enterprises in the occupied territories, in order to provide adequate legal support and consultancy for the partner of production. Remarkable issues drew the project team attention during the consultancy tasks and are currently being preceded by the contracted lawyers:

1- A sewing female worker in Nablus who has worked for 21 years was not given any of her annual leave or compensation.
2- A group of sewing female workers in Jenin were dismissed from their work without legal justification after 6 years of work.
3- A female cleaner from Salfeet was waived from her work due to age, and she eventually became without any financial supporter after 15 years of work at kindergartens.
4- A male worker from Jenin was subjected to electric shock while working in one of the public streets.
5- A group of employees from Hebron were dismissed due to personal disagreements with their employer.
6- A group of employees from Bethlehem have been deprived from their end of service benefits after working for so many years.
7- A group of employers were subjected to several injuries and disabilities and have not been compensated as a result of lack of commitment to the conditions of occupational health and safety by the employer.


As a result of these mobile clinics, Musawa and Relief International are currently working to adopt 20 labor cases free of charge and appeal within competent courts. In addition, Musawa and Relief International are committed to networking with stakeholders, civil society organizations, and official bodies to concentrate efforts and improve the environment and working conditions in the areas of the Palestinian National Authority.

The project "Access to Justice for Poor Women"   has been implemented in five districts, Nablus, Jenin, Salfit, Bethlehem and Hebron. Currently the project team is preparing for the next phase of the project which aims at the creation of local coalitions that uphold the PES document and guides and enhances the rule of law, thereby providing just and fair employment conditions. These coalitions will engage all stakeholders, local and national, in a wide range of activities in pursuit of the project objectives.
